Introduction

The general conditions of sale described below (hereinafter General Conditions), exclusively govern the contractual relations between any user of the website nitorlack.nitorlack.com (hereinafter referred to as “User” or “You”) and the seller, which is the company Valenciana de Recubrimientos, S.A, domiciled in Pol. Ind. La Reva – Sector 13, Avda. dels Gremis s/n., 46394 Riba-roja de Turía, Valencia – Spain, (hereinafter referred to as “Valresa”) and owner of the portal nitorlack.nitorlack.com.

These general conditions of sale are the only ones applicable and replace any other general conditions, except in case of prior, express and written cancellation. Valresa may occasionally modify the clauses of its general conditions, so it is advisable that these are read at each visit of the website nitorlack.nitorlack.com (hereinafter referred to as “Portal”). These modifications are applicable from their publication on the Internet (from the date at the beginning indicated) and may not be applied to contracts concluded previously. Each purchase on the site is governed by the general terms and conditions applicable on the date of the order. We consider that once you have placed an order, you have unreservedly accepted our general terms and conditions of sale after having read them.

By accessing the Portal, you agree to respect the General Terms and Conditions as well as the rules of use contained therein.

Valresa pays great attention to the information regarding the essential characteristics of the products by means of the corresponding Technical and Safety Data Sheets.

Prices

The sales prices indicated in the Portal are shown in Euros. Shipping costs are not included in these prices. The shipping service costs are borne by the User and will be added to the total amount of the selected products. You will be informed of these costs before confirming the order and finalizing the order process.

We reserve the right to modify our prices at any time. However, we undertake to apply the rates in force indicated on the Portal at the time your order is placed.

We inform you that in the event of an erroneous and/or clearly derisory price being displayed for any reason whatsoever (computer bug, manual or technical error, etc.), the order will be cancelled, even in the event of initial validation.

Shipping and delivery times

Products purchased in Valresa will be shipped to all Peninsular Spain, the Balearic Islands and the Canary Islands. We do not ship to Ceuta and Melilla.

For orders over 75 euros in the peninsula shipping is FREE.

Our products are governed by certain canons and security measures, which have to be applicable by the transport companies.

As we are companies specialized in ADR products, the freight charges can be significantly higher than in other sectors.

Prices without V.A.T. included

The shipping cost for mainland Spain and Balearic Islands on orders under 75 € will be 6,90 €.

The shipping cost for France will be 15,00€ for orders under 120€.

The shipping cost for Italy will be 15,00€ for orders under 120€.

The shipping cost for the rest of Europe will be 18,00€ for orders under 150€.

The order will be shipped to the address you indicated at the time of purchase, provided that the Delivery Method selected in the order is appropriate (Spain, Portugal, France, Italy, Germany and Rest of Europe).

The time between the placement of the order and the date of the first delivery attempt by the carrier at the address indicated in the order, corresponds to the sum of these 2 factors:
1. The delivery preparation time (3 to 5 days) = validation and verification of your data and payment + preparation of your order + collection by the carrier.
2. The transport and delivery time of your order:

Mainland Spain, Balearic Islands and Portugal (1 to 2 days).
Rest of Europe (3 to 5 days)
In both shipments, delivery times may increase during the second and third week of August and the last week of December.

These deadlines are indicated in working days.

Valresa makes every effort to respect the delivery times mentioned on the Portal. However, Valresa cannot be held responsible for the consequences of a delay in delivery or loss of the package caused by persons outside the contract of carriage, by yourself or for unforeseeable or insurmountable reasons or causes of force majeure. In addition, the method of payment chosen by you may affect delivery times.

In the event that you do not receive a package within the indicated deadline, an investigation will be carried out in conjunction with the carrier, which could take several days (the approximate period is fourteen (14) working days). During this period, no reshipment or refund of the order will be possible.

We advise you to verify upon receipt of your package that everything is in accordance with your order and in perfect condition. If you do not agree with the items delivered or their condition, please sign and indicate by hand on the carrier’s delivery note the anomalies you found upon receipt.

Customs Information

If your shipping address is outside the European Union, you may be subject to customs duties and other taxes that will be incurred once the products arrive in the destination country from where they have been ordered through nitorlack.nitorlack.com.

Any additional costs due to customs duties and/or tariffs will be borne by you. We have no control over these charges and cannot predict the nature or amount of these charges.

Customs policies vary significantly from country to country, so you should contact your local customs office for more information. Remember, also, that when you place an order through nitorlack.nitorlack.com, you are considered the importer of the products and must comply with all applicable laws and regulations in the country in which you are receiving the products. Generally, customs forms for international orders will list the value of the contents of your order by product type.

However, we want to inform you that international trade is subject to inspection and review by the appropriate customs authorities. We may be required to provide our freight forwarders with certain information concerning the products. Also, this information may need to be transferred to the relevant authorities to facilitate compliance with the relevant legislation.

Methods of payment

If our insurance company or our security department suspects any anomaly or fraud, we reserve the right to cancel your transaction for security reasons.

Valresa offers you 3 methods of payment: by credit card, by PayPal or by bank transfer.

Payment by credit/debit card

If you choose to pay by credit or debit card, your order cannot be considered and will not be processed until the payment has been authorized by your bank or cashier. Online payment by credit card is done through the security system that encrypts your bank details when they are transmitted over the Internet.

Payment by bank transfer

If you choose to pay by bank transfer, your order cannot be taken into account and will not be processed until we receive via e-mail to tienda.valresa@valresa.eso by fax to 961 668 665 the proof of the transfer made.

For security reasons, Valresa verifies all orders paid by credit card or bank transfer, which may cause a slight delay in the delivery time when you have chosen this method of payment.

In this case, additional information will be requested or required in order to accept your purchase.

Consequently, and in order to avoid delays with your shipment, please indicate when placing your order:
– A private or professional e-mail address.
– A telephone number (place of work or home) where we can contact you at any time.

In addition, for any order whose amount exceeds a scale fixed by Valresa, you will be asked for an identity document and a proof of address which you will have to send us by fax or e-mail which will be indicated in due course.

We apologize for any inconvenience this procedure may cause you. These security measures are a clear proof of our will to protect Valresa’s customers against possible bank fraud.

Returns. Right of revocation. Satisfied or refunded

The User has fourteen (14) working days to return a product with which he/she is not satisfied. Within this period, you may return the product (shipping costs shall be borne by you) along with the invoice and prior notice by e-mail to the address info@nitorlack.nitorlack.com.

This right of withdrawal does not apply to products which, by their nature, cannot be returned or which may deteriorate or expire rapidly.

We advise you to protect your item(s), as you will be responsible for any damage suffered during transport. Therefore, we suggest that you return the merchandise to us by carrier and with insurance for the value of the product. This insurance will be very useful in case of damage or loss of the goods by the carrier. In any case, the eventual costs of the return are to be borne by the consumer.

When the User returns a product in exercise of his right of withdrawal, only products that are sent in their original packaging, in perfect condition and complete will be accepted. Items that have been sent incomplete, damaged or deteriorated by the Customer will not be accepted.

The deadlines mentioned above apply from the day of receipt of the order.

Litigation and liability

Valresa cannot be held responsible for the non-execution of the present conditions in the event of force majeure and in the event of the customer’s fault or an unforeseeable event by a person outside the contract.

Valresa cannot be held responsible for any consequences that may result from the improper use of the products sold on the Portal.

Although certain products may have features compatible with professional use, Nitorlack.com is not a Portal dedicated to the sale to professionals, so it can not be held responsible for any complaint related to a professional activity.

Comments, reviews, communication

All opinions written by users of the Portal are controlled by the marketing team. If the opinions received infringe the law, ethics or morals (abusive advertising, defamation, insults, comments out of context…) Valresa reserves the right to refuse or modify such opinions.
